1. About these terms
These Terms of Use apply when you access or use:
- the Mnemply website;
- the Mnemply Foundation Program;
- Mnemply lessons, games, applications and activities;
- downloadable or online educational materials;
- associated account and course services; or
- any other Mnemply service that links to these terms.
Mnemply is operated by Intertag Pty Ltd (ABN 64 090 761 363) in Queensland, Australia.
In these terms, “Mnemply”, “we”, “us” and “our” refer to Intertag Pty Ltd.
By creating an account, accessing a course or using Mnemply, you agree to these terms.
If you are using Mnemply on behalf of a child, you confirm that you are the child’s parent, guardian or another responsible adult authorised to supervise that use.
2. The Mnemply service
Mnemply provides educational resources that use memory techniques, characters, images, sounds, stories and activities to support learning.
The Foundation Program currently begins with multiplication fact recall.
Mnemply is designed to supplement broader mathematics instruction. It does not replace:
- classroom teaching;
- a school curriculum;
- professional educational assessment;
- specialised learning support;
- medical or psychological advice; or
- advice from a qualified teacher or health professional.
3. Accounts and adult supervision
A parent, guardian or responsible adult should create and manage the account used by a child.
You agree to:
- provide accurate account information;
- keep contact information current;
- protect usernames and passwords;
- supervise a child’s use where appropriate;
- notify us if an account may have been accessed without permission; and
- take reasonable steps to prevent misuse.
You must not:
- share an account publicly;
- sell or transfer account access;
- permit unrelated households to use a personal account unless we expressly allow it;
- impersonate another person; or
- attempt to obtain another user’s login details.
4. Children’s use
Mnemply is intended to be experienced with appropriate adult awareness and supervision.
Parents and carers are responsible for deciding:
- whether Mnemply is appropriate for their child;
- how long the child uses the service;
- whether the child needs help navigating lessons or activities; and
- whether additional educational or professional support is needed.
Children should not use contact forms, provide identifying information, upload material or communicate directly with Mnemply without the involvement of a parent or guardian.
5. Free Foundation access
The Foundation Program is currently offered free of charge unless clearly stated otherwise.
Free access:
- may require creation of an account;
- may require a valid email address;
- may be delivered through a third-party course platform;
- may be updated as the program is refined; and
- does not create an entitlement to every future Mnemply product or paid program.
We will clearly disclose any price before a user enters a paid transaction.
We will not charge a payment method merely because someone creates a free Foundation account.
6. Educational outcomes
Children learn differently, and no educational method works in the same way for every learner.
Mnemply does not guarantee:
- particular test results;
- instant or effortless recall;
- mastery within a particular time;
- improved school grades;
- elimination of anxiety or frustration;
- suitability for every child; or
- a particular long-term educational outcome.
References to an estimated completion time are guides only. Actual time will vary according to the learner, family, pacing and use of the activities.
Nothing in this section limits any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
7. Pilot and developing features
Some Mnemply resources may be provided as part of an early pilot, preview, beta or testing program.
During these stages:
- instructions may be refined;
- lesson order or pacing may change;
- visual or technical features may be updated;
- errors may be corrected;
- activities may be added, removed or replaced; and
- the experience may differ between devices.
Feedback is welcomed, but participation does not give a user ownership of Mnemply or its materials.
Compensation for feedback is not promised unless a specific pilot agreement says otherwise.
8. Acceptable use
You may use Mnemply for personal, household and educational use in accordance with these terms.
You must not:
- copy, reproduce or distribute substantial parts of Mnemply without permission;
- upload course materials to public websites, file-sharing services or social media;
- record or redistribute lessons except where we expressly permit it;
- remove copyright, trademark or attribution notices;
- modify materials and present them as official Mnemply resources;
- reverse engineer, scrape or automatically extract the website, games or course content;
- interfere with security or access controls;
- introduce malware or harmful code;
- use the service unlawfully;
- harass, threaten or harm another person;
- collect information about other users; or
- use Mnemply to build or train a competing commercial product without written permission.
9. Intellectual property
Mnemply and its materials contain intellectual property owned by or licensed to Intertag Pty Ltd.
This may include:
- the Mnemply name and logo;
- Mnemply terminology;
- characters and Cousins;
- Jace, Mira and other story-world elements;
- Memory Spots;
- Mem-Links and Mem-Link Chains;
- the Secret Code presentation;
- illustrations, animations and videos;
- lesson scripts and recordings;
- games and software;
- page design;
- text, audio and graphics;
- downloadable resources; and
- course structure.
Creating an account does not transfer ownership of this intellectual property.
Subject to these terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable right to use the materials for private household and educational use.
Any broader reproduction, publication, adaptation, commercial use or distribution requires our prior written permission.
10. User feedback and submissions
You retain ownership of original feedback, comments, photographs, recordings or other material you provide.
Do not submit identifiable material concerning a child unless:
- you are authorised to provide it;
- the submission is reasonably necessary; and
- you understand how it may be used.
Unless we separately agree otherwise, you give Mnemply permission to use non-confidential feedback to:
- investigate problems;
- improve lessons and products;
- understand the user experience; and
- develop future Mnemply services.
We will not publicly use an identifiable child’s name, image, voice, testimonial or story for marketing without appropriate permission.
11. Availability and changes
We aim to keep Mnemply available and functioning, but uninterrupted access cannot be guaranteed.
Access may occasionally be affected by:
- maintenance;
- software updates;
- internet or hosting outages;
- third-party platform issues;
- security incidents;
- device or browser incompatibility; or
- circumstances outside our reasonable control.
We may improve, update, replace, pause or discontinue parts of the service.
Where reasonably practicable, we will try to provide notice of a significant change affecting current users.
12. Third-party services
Mnemply may use or link to third-party services, including course-hosting, video, email, analytics and authentication providers.
The Foundation Program currently uses Systeme.io for signup forms, account access, course enrolment, course delivery and related emails.
The use of a third-party service may also be governed by that provider’s terms and privacy policy.
We are not responsible for content or services supplied independently by a third party, except to the extent responsibility cannot lawfully be excluded.
13. Links to other websites
Links may be provided for convenience or further information.
A link does not necessarily mean that Mnemply endorses or controls the linked website.
Users should assess third-party content and supervise children when leaving the Mnemply environment.
14. Suspension or termination
We may suspend or terminate access where we reasonably believe that:
- these terms have been seriously or repeatedly breached;
- an account is being used without authority;
- use creates a security, legal or safety risk;
- materials are being unlawfully copied or distributed; or
- suspension is reasonably required to protect users or the service.
Where appropriate and reasonably practicable, we will try to explain the issue and provide an opportunity to correct it.
A user may stop using Mnemply at any time and may contact us to request account closure.
15. Liability and Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded under the Australian Consumer Law or another applicable law.
To the extent permitted by law:
- Mnemply is provided for general educational purposes;
- users remain responsible for deciding how the materials are used;
- we are not responsible for an outcome caused solely by reliance on Mnemply as a substitute for appropriate teaching, professional assessment or support; and
- we are not liable for loss caused by a user’s unlawful conduct, unauthorised account sharing or failure to keep credentials secure.
16. Privacy
Our collection and handling of personal information is explained in the Mnemply Privacy Policy.
17. Changes to these terms
We may update these terms to reflect:
- changes to Mnemply;
- new services or features;
- changes to our providers;
- changes in law; or
- security and operational requirements.
The updated terms will be published on this page with a revised date.
If a change materially affects current users, we may provide additional notice.
Continued use after updated terms take effect indicates acceptance of those terms, except where the law requires another form of agreement.
18. Governing law
These terms are governed by the laws of Queensland, Australia.
The parties submit to the courts and tribunals having jurisdiction in Queensland, subject to any rights a consumer has to bring a claim in another jurisdiction under applicable law.
